The United States Citizenship and Immigration Service (USCIS) has announced that it has received enough petitions from employers in order to reach the fiscal year 2023 cap regarding the H-1B speciality occupation visas.
In addition, USCIS has announced that it also notified all applicants whose requests for H-1B visas have been rejected, VisaGuide.World reports.
In order to reach the congressionally mandated visa regular cap, the USCIS must receive a total of 85,000 applications.
“USCIS has received a sufficient number of petitions needed to reach the congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa United States advanced degree exemption, known as the master’s cap, for fiscal year (FY) 2023,” the statement published by USCIS reads.Recently, it has been reported that the United States Citizenship and Investment agency will not hold a second H-1B cap lottery. Despite the fact that such an announcement has not been confirmed.
“There may not be a second H-1B lottery this year. This is because the USCIS has issued several ‘non-selection’ notices, which is a step taken only when there will be no more lotteries,” managing attorney at Immigration.com, Rajiv Khanna, stressed in this regard.The recent publication of the USCIS says that the status for properly submitted requests for the FY 2023 H-1B numerical allocations but that were not selected from now on will show: not selected- not eligible to file an H-1B cap petition based on the registration.
“We will continue to accept and process petitions that are otherwise exempt from the cap. Requests filed for H-1B workers who have been counted previously against the cap and who still retain their cap number are exempt from the FY 2023 H-1B cap,” the statement reads.The H-1B visa, also known as a Person in Speciality Occupation Visa, allows internationals engaged in fields such as IT specialists, architects, accountatants, professors, doctors, and lawyers to temporarily work in the United States provided they meet specific conditions. Recently, it has been reported that as of 483,927 H-1B cap registrations have been received by the agency for this fiscal year, making an increase of 7 per cent compared to last season’s figures. Of the total, the agency has selected 127,600 registrations or 26 per cent more, to meet the H-1B quota. Authorities in the United States previously announced that the registration process was open from March 1 until March 18.
