During the hearing held on Wednesday, she said that no court in the country has ever endorsed the president’s interpretation, stressing that this court would not be the first.

In Maryland, the case has been filed by five pregnant women and two immigrant-rights groups amid concerns that the US President’s order could affect their babies, as reported by CNN.

The government will not be harmed by a preliminary injunction that prevents it from enforcing an executive order likely to be found unconstitutional.

Trump’s Order May Reach High Court for Review

Judges in several states are considering similar injunctions this week, with legal experts stressing that the matter will eventually reach the high court in order to be reviewed.

In yesterday’s hearing, Boardman said that citizenship is a most precious right guaranteed by the 14th Amendment. The Judge warned that President Trump’s order would bring serious harm if it would become effective in the coming weeks.

Children subjected to the order will be denied the rights and benefit to US citizens and their parents will face instability and uncertainty about the citizenship status of their unborn babies.

The order signed by the US President, Donald Trump, last month, aims to put an end to birthright citizenship in the country. If it would become effective it would go against the current law, that permits babies born in the US to parents who are not US citizens, to be granted citizenship.

It would affect children born in the US territory to parents who do not obtain citizenship, including mothers obtaining legal visas or irregularly staying in the US and fathers who are not US permanent residents or US citizens.
