FY 2025 H-1B Cap Selection Process Completed, USCIS Announces

Key Takeaways

  • The USCIS has finished the initial electronic registration selection process for H-1B visas.
  • They received a sufficient number of registrations to meet the fiscal year 2024 H-1B numerical allocations, including the advanced degree exemption.
  • USCIS has notified all petitioners with selected beneficiaries, allowing them to file H-1B cap-subject petitions.

The United States Citizenship and Immigration Services (USCIS) has announced that the H-1B initial electronic registration selection process has been completed.

Through a statement, the USCIS has stressed that it has received enough electronic registrations during the initial registration period in order to reach the fiscal year 2024 H-1B numerical allocations, taking into account the advanced degree exemption, VisaGuide.World reports.

We have randomly selected enough properly submitted registrations for unique beneficiaries projected as needed to reach the H-1B cap and have notified all prospective petitioners with selected beneficiaries that they are eligible to file an H-1B cap-subject petition for such beneficiaries.

The agency emphasized that now for each registration registrants’ online accounts will show the following statuses:

  • Submitted: The registration has been submitted and can be chosen. If the first selection is done, the registration stays valid for any future selections in the same fiscal year unless subsequently invalidated.
  • Selected: Chosen to file an H-1B cap petition.
  • Not Selected: Not chosen to file an H-1B cap petition based on this registration.
  • Denied – Duplicate Registration: Multiple registrations were submitted for the same person by the same registrant. If denied as a duplicate, all registrations submitted for that person by the same registrant for the fiscal year are considered invalid.
  • Invalidated – Payment Issue: A registration was submitted but the payment method was declined, failed or was otherwise invalid.
  • Deleted: The submitted registration has been removed and is no longer eligible for selection.
  • Processing Submission: USCIS is working on the submission. It may take up to 72 hours for all case details to appear.

FY 2025 H-1B Cap Petition Filing Began on April 1

From the beginning of this month, H-1B cap-subject petitions for FY 2025, taking also into account those for advanced degree exemptions, can be submitted to USCIS. However, the agency emphasized that only those petitions filed for selected beneficiaries and based on valid registrations are accepted.

USCIS said that only those who have registrations for selected beneficiaries are eligible to submit H-1B cap-subject petitions for FY 2025.

An H-1B cap-subject petition must be properly filed at the correct filing location (see H-1B Form I-129 Filing Location Change to Lockbox section below) or online at my.uscis.gov and within the filing period indicated on the relevant selection notice. The period for filing the H-1B cap-subject petition will be at least 90 days.

In addition, petitioners must also submit evidence of the H-1B beneficiary’s valid passport or travel document used at the time of registration in order to identify the beneficiary.
